Effective brownfields transactions are the result of expert management of environmental and financial risks. At LandBank, our experts have the
tools and the knowledge base that allows them to effectively manage
those risks.

LandBank evaluates the property conditions, the deal structure, and the liability concerns of buyers and sellers to determine the specific requirements for each transaction. Risk management factors include the selection of remedy, regulatory options (including voluntary cleanup or prospective purchaser agreements), the legal structure of ownership, and investment participation.

Transactions may also involve the use of bonds, indemnities, guarantees, escrows, and other tools to control and limit financial, technical, and regulatory risks. In combination with our innovative insurance programs, LandBank’s risk management strategies have effectively limited risks to risk-averse corporate sellers and investors.

LandBank’s risk management program also supports clients with environmental property issues that result from planned divestitures, mergers, acquisitions, or refinancing. We help our customers place effective environmental insurance for their impacted properties.

LandBank manages the risk of environmental liabilities on its properties in three significant ways:

  • Remediation – LandBank manages the cleanup necessary for
    each project. Although every remediation plan is unique to each project, our goal is to eliminate the source of the contamination wherever feasible.
  • Insurance – LandBank’s insurance program provides a broad scope of coverage for environmental risks and cleanup. We work with top-rated carriers to develop the most current and comprehensive coverage, while underwriting the unique environmental characteristics of each specific transaction.
  • Regulatory Closure – Once remediation has been completed, LandBank works with the responsible governmental agency to achieve the appropriate completion status.
